Update: Elections official resigns over gay marriage ban

RALEIGH (AP) — The top elections official in a socially conservative county has resigned, saying she could not in good conscience preside over the upcoming vote on a proposed amendment to the state constitution banning same-sex marriage.

Former Harnett County Elections Director Sherre Toler said her romantic relationship with a man of a different race cemented her belief that the civil rights of people in love shouldn't be determined by majority rule.

State elections workers are discouraged from expressing personal opinions about issues on the ballot so they don't feed a perception that those counting the votes are biased. Toler, a registered Democrat, had the job 11 years.

She said her Jan. 3 resignation will enable her to speak publicly on an issue she is passionate about and work with groups seeking to defeat the May referendum.

"The rights of a minority group being put to a popular vote," the 51-year-old Toler told the Associated Press. "It's immoral and unconstitutional."

Same-sex marriage is already illegal in North Carolina, but in September the state's Republican-led legislature voted to put a referendum on the state's primary ballot in May that would insert language into the state constitution defining marriage as being between one man and one woman.

Harnett County, located about 45 minutes south of Raleigh, was once a rural Democratic stronghold populated largely by tobacco farmers. But as the county has grown it has also steadily moved into the Republican column, voting for the McCain-Palin ticket by a double digit margin in the 2008 presidential election.

Though state laws barring mixed-race marriages were struck down as unconstitutional in the landmark U.S. Supreme Court ruling Loving v. Virginia more than 40 years ago, Toler said people still sometimes stare disapprovingly when she dines in restaurants with her boyfriend.

"Even in 2012, there are people who think my relationship should be illegal," said Toler, who has an adult son from a previous marriage.

Harnett County Commissioners Chairman Tim McNeill, a Republican who is currently campaigning for the state senate, praised Toler's performance at the election's board.

"I can honestly say she made sure we had fair and impartial election," McNeill said in an interview with The Sanford Herald (http://bit.ly/wpeFBj ). "She's always been a strongly opinionated lady, and I guess she felt she needed to make that move so she could express those views."

Toler said her family and friends have been very supportive of her stand, which became public after she sent an email explaining her decision to a handful of left-leaning blogs. In the same email, she also announced she is launching a political consulting firm with the hope of working for progressive candidates and groups.

That prompted some conservative bloggers to suggest her resignation was prompted more by a plan to make money than morality, pointing out she filed the required legal paperwork to create her business days before submitting her official letter of resignation with the county.

"In case you may have thought Ms. Toler's actions were a result of moral outrage — the timing of her actions appear to be of the more calculated rather than the outraged type," wrote Karen Duquette, a commentator for the conservative Civitas Institute.

Toler said she hopes to work with candidates and groups seeking to defeat the marriage referendum.

"This isn't about me," said Toler, who quoted the Rev. Martin Luther King Jr.: "'Our lives begin to end the day we become silent about things that matter.'"

Glad to see that the Hartnett County Elections Director has clarity of mind and conviction to resign from a public trust position with the upcoming vote on ban of same sex couples being allowed to be married in NC. I don't see the relevance of the statement in the article that she is "romantically" involved with a man of another race. How about AP just saying that the ex-official is dating a man of a different ethnicity. As for views held here in our household, same sex marriage and sex outside of wedlock are both sinful behaviors as defined by the Holy Scripture. You may try to beat God, but He never is on the losing side.

Ethnicity and race aren't the same thing. An Irishman and a Pole are of different ethnic groups; both are white.

The article makes the point of Ms. Toler quite clear. She is saying that banning same sex marriage is no different from banning mixed race marriage . . . and the latter has already been ruled unconstitutional.

Sex outside of wedlock isn't an issue in this article so I'm not sure why you bring it up.

So, madisonman, since you're such a Scriptural guy . . . do you eat shrimp? Combine dairy products and meat on the same table? In for a penny, in for a pound; if you're going to fixate on one aspect of the Bible's laws, you have to obey all of them.

Do you eat kosher? If you're not, you're committing sin . . . better get right with God.

If you accept one you must accept the other, Accepting one and rejecting the other is a Chinese buffet approach to religion. Take what you want and leave the rest.

I don't take the Bible literally.

Please answer my question: If you insist on believing homosexuality is an "abomination" do you also conform to Gods other laws as laid down in Leviticus? Do you eat kosher? Do you keep the Sabbath (Friday pm to Sat am)? Does your wife ritually bathe herself after her period? Should we stone adulterers?

If you insist on keeping on law you must keep all the others. In for a penny in for a pound.

For now, I'll assume your answer is no you do not adhere to these other laws.

You don't see the connection between interracial romance and gay romance? Not a student of history, I'm guessing. It was during my lifetime that laws in the South were changed to allow interracial couples to marry. And when that change to marriage laws took place, religious authorities were in the fray, arguing that the Bible says it is a sin to marry someone not of the same race.

Do you see the connection now?

The point is relevant. If it is unconstitutional to discriminate based on race, why is it constitutional to discriminate based on sexual identity?

Bestiality is not part of this discussion. Animals can't give informed consent. People can.

Why is it so terrible to call it what it is, marriage? Why is that such a horrible thing?

It's not a horrible thing. It's just that "green" is not "blue." Whether you believe marriage to be of divine or mortal origination, it has, for the entirety of social history, been defined as a contract between a man and a woman for the purpose of protecting the inheritance and well being of the children they create. Gay couples do not create children.

Based on the acceptance of the term "civil union," I would suggest that tolerance has been achieved. Insisting that everyone else quantify their relationship ("I'm in a heterosexual marriage") goes beyond tolerance - and bangs on the door of the belief systems of others.

You haven't answered my question, but instead answered with a straw man argument.

Why is gay marriage horrible?

It doesn't matter what used to be. Men also used to be able to use a stick the diameter of their thumbs to beat their wives . . . they can't any more. Many marriages do not result in children, either by choice or by biology.

Why is gay marriage horrible? Until you can explain why it is so horrible, you can't claim tolerance is achieved.

One of the biggest problems with this debate is the overlap in terminology. Marriage is a religious sacrament and/or joining and it is also as legal relationship regulated by the state. The government cannot ever require a church to "marry" two people in violation of their faith. However, to discriminate against people by not allowing them to enter into the legal relationship also called marriage solely because of sexual orientation (which is as immutable a characteristic as race) violates the Equal Protection Clause of the US Constitution. The religious institution of marriage and the legal relationship of marriage are different and need to stay that way. Each to his own religious beliefs, but government needs to treat everyone the same.

I agree. Perhaps all couple commitments should be "civil unions" in the eyes of the law, and most importantly - establish equal legal standing in all states. Leave the use of "marriage" to each's own.

Are you aware that the constitutional amendment on the ballot in May includes language that outlaws gay marriage (somthing that is already illegal in NC) also makes it impossible for people to enter into ANY type of legal domestic partnership? This is a BAD piece of legislation that gives North Carolinians FEWER rights than they have today.
Particularly ironic that while a corporation is now considered a person, if this amendment passes a person will have fewer rights than a corporation (no right to form a partnership). This gives lie to all the people who say they want smaller government but support this amendment.

A man and his dog or a woman with 2 men? Wow, someone just isn't paying attention to the facts and wants to play the hyperbole game. OK lets address this as easily as we can. What gay Americans want is the ability to marry the person (notice that I said person, not people) they want to. Murderers on death row are allowed to marry. However 2 men in a long standing committed relationship who contribute time and money to the community can't. Thump all the bibles you want, that will still be wrong. As for the dog, two adults who understand the contract of marriage and all of the consequences is not the same as an obsessed adult and a dog who doesn't even know there is a such thing as law, not to mention a marriage license. What you are doing is equating one of those adults to a canine.

There are quite a few other things listed as well and I'm willing to be my life that you don't stay away from everything that is proscribed in the old good book. There are hundreds of "laws" in the Bible that most Christians conveniently ignore when it doesn't suit their modern lives. Once you're following each and every single one of them your comments about what others are doing would be more relevant. Until that time it comes off as nothing more than hypocritical.

Perhaps you should worry more about yourself and less about others. It is NOT the job of the government to uphold laws relating to your religion. Period.

Well of course “good Christians” always cherry pick from the Holy writ. Take a little fruit from one section, but leave some in the next; or, take what suits you from your favorite parts of the Bible and forget about the rest. Like many of you, I’ve seen it all my life. And I always love the Christians who argue that in these days and times, people should just follow the New Testament and forget about the Old Testament. Last time I checked though, the Old and New Testaments were included in one giant cover. So it is perfectly fine to just forget about the old stuff? Isn’t that like forgetting history? Wouldn’t that be like remembering World War II and forgetting about World War I and the Civil War and all the other stuff before?

But really, I think all “good Christians” should follow every rule in the Bible from cover to cover. You think that two gay men should be ostracized and denied basic rights? You say its God’s way and it says so in the Bible? Okay, fine. But while you’re following the Lord’s orders, you should follow them all. So all of you dyed in the wool Christians, get thee ready.

Examples include: Burning animals as sacrifices so it will create a pleasing odor for the Lord (Lev.1:9), Selling your daughters into slavery (Exodus 21:7), Have no contact with a woman while she is in her period of menstrual uncleanliness (Lev.15: 19-24), You may possess slaves, both male and female, provided they are purchased from neighboring nations (Lev.25:44), Eating shellfish is an abomination (Lev.11:10), Man may not approach the altar of God if he have a defect in my sight (Lev.21:20), Males are expressly forbidden to have the hair trimmed from the temples or sides of their heads (Lev.19:27), Man must not touch the flesh of a dead pig because it is unclean (Lev.11:6-8), Man violates God’s law if he plants two crops in the same field or wears garments made of two different kinds of threads (Lev.19:19), If he curses and uses God’s name in vain then he must be stoned to death (Lev.24:10-16) and last but not least, certain sex acts with the family could end up with you being stoned to death (Lev.20:14).

So in a nutshell, what does this all mean for you “good Christians” out there? It means you could get into trouble for animal cruelty and animal sacrifices, not being around your wife while she’s cycling (and I don’t mean on her bike), you can’t go to the barber shop to get a trim, you can’t eat at Henry James BBQ or Red Lobster anymore, you can’t plant pumpkins and corn in the same field, you’ll have to forget about wearing that Brooks Brothers cotton/wool blend suit to church on Sunday, and I pray you get a good price for your daughters when you sell the girls into slavery. Oh, but it will be perfectly fine to have slaves from Mexico and Canada to trim your hedges and clean your houses. The Lord should find that as being okay.

I mean, if you’re going to cherry pick from God’s word, then you should have no issues with picking the rest so you’ll all be worthy to enter the Kingdom to face your judgment. Right?

Here we go again. Crazy fundamentlist misrepresenting my faith. The definition of Marriage in the Bible was fluid. Heck, polygamy was pretty much standard. To claim that biblical marriage is between one man and one woman is at best ignorant and at worst, dishonest. Some churches believe it is okay to marry people of the same gender. Why limit their freedom of religion based on your interpretation of a sacred text. This whole referendum thing is just another appeasement for the extreme right. Spend your time living what Jesus taught (see Matt 6) and stop worrying about everyone else's life.
