WINSTON-SALEM (AP) — The man killed in a head-on crash that seriously injured state legislator had a blood alcohol content that was more than three times the legal limit for driving in North Carolina.
Winston-Salem police said in a report updated today that David Carmichael, 54, had a blood alcohol content of 0.29 percent when he was killed in the wreck Dec 2.
State Rep. Larry Womble remains in serious condition at Wake Forest Baptist Medical Center. Police said he had no alcohol in his system.
Police said previously that Womble, 70, crossed the center line in the 2600 block of Reynolds Park Road in his 2012 Acura and collided head-on with Carmichael's 1996 Chrysler convertible.
Police said Womble was driving 50 mph in a 45-mph zone; Carmichael was going 45 mph.
Investigators found no skid marks on the road, which suggests that neither driver applied his brakes. Womble was not wearing his seat belt.
Police said no charges will be filed.
Womble is a Democrat serving his ninth term representing Forsyth County.
The legal limit for a driver's blood alcohol content is 0.08.
