Dec. deadline for govt. reply in MacDonald case
RALEIGH (AP) — A federal judge has given the government until Dec. 1 to respond to a motion by attorneys to get a new trial for the former Army doctor convicted of the 1970 killings of his pregnant wife and two daughters at Fort Bragg.
Judge James C. Fox signed the order Wednesday, the same day motions were filed by attorneys representing Jeffrey MacDonald. They want a federal court to consider the DNA test results that already exist and order a new trial. If not, the lawyers want permission to conduct new DNA testing in the case.
The motion says both The Innocence Project, a New York-based group that uses DNA evidence to exonerate people, and the Durham-based North Carolina Center on Actual Innocence have agreed to pay for the new testing.
