Early release of criminals shows court malfunction

In your editorial on Dec. 16, you write: “Our leaders should save their disgust for instances when judges disregard the law. Perdue, however, is exploiting a volatile issue to direct public animosity toward the courts.”

Former Gov. Jim Hunt has been quoted as saying much the same thing as Perdue on this issue. Would you accuse him of trying to direct public animosity against the courts?

There are times when the system of justice malfunctions, such as the acquittals in that too-often-referred-to-and-infamous Greensboro shoot-out. Releasing dangerous prisoners on legal technicalities looks to some people like another malfunction.

Unfortunately, this fiasco (the pending release) is a success story, not a malfunction, of our justice system. I would agree, however, that it is a major failure for our legislative system.

No, it is the success story of a convict facing life imprisonment for murdering two people, and who originally faced a death sentence, who has figured out a way to game the system. It is a disgrace that the judges have allowed this jailhouse "rules lawyer" to pervert the intention of the fair sentencing legislation. Their job is to interpret the law and that includes taking into account its intent, not permitting some intricate sophistry to thwart that intent.

It is the court/judge's job to interpret the law and three seperate judges have come to the same conclusion.
They did not "allow" anyone to pervert the law, not even the state. Other than those who will be released as a result of these conclusions, I doubt anyone is happy about the end result. Hopefully, a lesson shall be learned by our legislators - all bills must be crafted carefully and worded precisely.
