Rep. Pricey Harrison wants Blue Cross probe

RALEIGH — Rep. Pricey Harrison has asked the state’s attorney general and Department of Insurance to investigate Blue Cross Blue Shield of North Carolina’s use of campaign-style tactics aimed at defeating controversial federal health insurance legislation.

The Greensboro Democrat wants to know whether the insurer violated the state’s do-not-call registry law with an automated message in late October. And she questions whether it is proper for the insurer to use its premiums to pay for the calls and two recent pieces of direct mail.

“I have heard from a number of constituents who were really upset about the postcard campaign,” Harrison said Thursday. “There are a lot of angry taxpayers, policyholders and state employees.”

Harrison has been a backer of the state’s do-not-call registry and said people on that registry, such as herself, were receiving the calls. That law typically prevents companies from calling and soliciting new customers or donations.

“These aren’t solicitation calls. We’re not soliciting anything,” said Lew Borman , a spokesman for the insurer. Households that received the calls were drawn from voter registration rolls. There is an exemption in the law for political activity.

Blue Cross Blue Shield is the state’s largest insurer with more than 3.7 million members.

Borman said the company does not oppose all health insurance reform efforts under way.

But the company does believe that creating a public health insurance option — a mechanism by which a federally subsidized plan would compete with the private market — would drive up costs for companies and premiums for those who are insured.

“Our folks think we have a responsibility to be involved,” Borman said. “After all, who knows more about this stuff and how it works and what impacts changes could have than we do?”

The mailers in question included a postcard that could be mailed to U.S. Sen. Kay Hagan , a Greensboro Democrat, urging her to oppose the public option. Hagan said recently that she supported the public option contemplated by Sen. Harry Reid of Nevada.

Harrison questioned whether it was appropriate for the insurer to use its funds given its “preferred tax status” as a not-for-profit.

“I am concerned that they have potentially violated their business charter by engaging in political advocacy,” Harrison wrote in a letter to the attorney general and Department of Insurance.

Harrison misunderstands the company’s status, Borman said.

“We are a fully taxed medical services and hospital corporation,” Borman said, adding that the company paid $162 million in federal, state and local taxes last year.

However, the fact the company paid taxes does not make it a for-profit company, said Adam Searing , a health policy expert with liberal-leaning advocacy group The North Carolina Justice Center.

“They are a nonprofit organization,” Searing said. “They are organized under a special part of the nonprofit corporation law in North Carolina. They have a nonprofit board.”

The company does not have shareholders nor is it a mutual company owned by its members. And Searing points out there is a whole provision of the law governing Blue Cross and Blue Shield that would govern its conversion to a “for-profit” company should the insurer ever decide to do that.

Harrison and Searing say that it’s appropriate for the attorney general and the state’s insurance regulators to ask questions about what could be construed as taxpayer-abetted political activity.

“We’re reviewing the complaints we have received regarding the mailing and will assess the letter’s requests when we receive it,” said Noelle Talley , a spokesman for Attorney General Roy Cooper.

A spokeswoman for the Department of Insurance said officials would review the request but said state law gave the regulators little say over a company’s communications strategy or political activity. The department, she said, was focused on ensuring companies could meet their obligations to policyholders.

Everything that BCBS did was legal. They are allowed to do whatever they want with their "profits". Unless, of course, we no longer live in a free country where one can question government and the government can now tell ANY company what it can and can't do in its own best interest. The "probe" is a flagrant ploy to shut them up and a shameful waste of taxpayer dollars. Wake up America!

Actually, that's not true. Non profit corporations like BCBS are obligated to return any profits to pay health care claims for their members. They are not allowed to get involved in politcs. They get tax breaks and exemptions from laws governing corporations in return.

If Insurance, drug, healthcare industry, and other companies aren't allowed to 'as you say - be in politics', then what do you call 'supporting/backing politicians'? Taxpayers are fed up with having to pay more for insurance, drugs and healthcare due to all this 'supporting/backing of politicians!' It's time for all these companies to 'PULL ALL SO-CALLED DONATIONS, SUPPORTING/BACKING, ANY POLITICIAN AND START BY REDUCING DRUGS, PREMIUMS, AND SERVICES, being paid by Taxpayers who have a job at present, BY NINETY-FIVE PERCENT (95%)!' This would be a start to stopping the corruption and greed and putting America back on track!

Drug companies are for profit. They are allowed to lobby. Trade groups representing both for profit and non-profits are allowed to lobby.

The non profit itself is not supposed to lobby or endorse any specific candidate or legislation. There are nuances in the law; advocacy groups are allowed to lobby-that's their reason for being. But BCBS is not an advocacy group It sells insurance under state laws. Its profits are supposed to go back into running BCBS and covering claims.

Since the concern seems to be Blue Cross Blue Shield campaigning against the health care reform how about wasting more taxpayer dollars and probe AARP because they are actively campaigning for passage.

Taxpayers should have no interest in AARP, as this is just another organization making you think because you're reached 65 'THEY'RE ON YOUR SIDE!' Check to see how much money they gave to politicians!
Again, it's time for drug, insurance, healthcare professions, and other companies to STOP 'supporting/backing' politicians. This is called 'DISCRIMINATION AGAINST TAXPAYERS!'

Actually, the issue is that a large number of Americans would like to be able to get health care AND not go broke. And this is what we voted for. Obama clearly said that health care reform was needed. That and the economy were the two main reasons Obama won. And the economy is turning around. How about you get off your indignation high horse, and realize this will be excellent for the economy and the American citizens. Social Security was created in the middle of the Great Depression, and helped lead to the end of that economic maelstrom. Now that we are in another depression, and Congress overwhelmingly passed unemployment benefit extensions, how can you logically agree that handing people cash to _not work_ is better than _helping_ people who _are_ working and paying taxes(not giving outright, but merely providing a partial tax credit). Besides, if your workers are healthy, the businesses have more productivity, fewer sick days, and other advantages that quickly combine to offset any minor increase in cost.

Obama, Pelosi & Reid won't make it public. These attempts to dismantle our country, piece by piece, need to be thwarted BY THE PEOPLE and these traitors, perpetrating these crimes, should be tried and convicted of treason. Please, anyone, tell me where in Article 1, Section 8, of our Constitution, does it give the congress the authority to FORCE people to buy health care. (And don't give me the BS about "General Welfare". That issue has been settled by the writings of our forefathers. General Welfare of the government, not the people.) Call your representatives and your senators... Ask them the same question. Also ask them why they won't make it mandatory that they too be covered under their own legislation. I imagine you'll get the same answer I got from Kay Hagen... (crickets, crickets...) Deafening silence.

The terrific thing about the way big corporations operate--whether they be banks, drug manufacturers, investment houses, oil companies, car companies, or insurance companies--is how well they get members of the public to support them when it really isn't in the public's best interests. The companies rely on knee-jerk reactions about "free enterprise" and "the American way"...all the while the CEOs and bigwigs laugh as they rake off millions. Wake up, ya'll, these people aren't your friends!

THIS is your idea of how the country should operate: CEOs getting millions while the unemployment rate is over 10%, banks getting bail outs then paying mega-bonuses, insurance companies lobbying congress while millions can't get health insurance, oil companies making huge profits while you can't afford gas? If so, then they've got you where they want you.

This country was built by small and medium sized business' not government. Free Enterprise and Capitalism is the only way we will rebuild this economy!!!
