Community colleges to enroll illegal immigrants

RALEIGH (AP) — North Carolina's community college system voted today to admit illegal immigrants at its campuses next year, a move unlikely to bring an immediate surge in undocumented students given a requirement that they pay higher tuition.

The State Board of Community Colleges approved the rules, which according to proponents will provide clarity after four previous policy changes on the topic since 2001.

A no-admission policy, with some rare exceptions, has been in place since May 2008, but Friday's vote will open more opportunities for Latino residents to succeed, an advocate said.

"We are thrilled with the decision," said Marco Zarate, president of the North Carolina Society of Hispanic Professionals. "We believe that education is something that is probably one of the few things that once you have it, nobody can take it away from you."

The changes are designed to focus on children who entered the country illegally with their parents and didn't make the decision to come to America, said Stuart Fountain, chairman of the policy committee that recommended the policy change to the full board.

"These children cannot be held in limbo with the federal government decides what to do with immigration," Fountain said. "While in high school they have adopted American culture and they've learned to speak English."

Democratic Lt. Gov. Walter Dalton cast the only "no" vote against the policy in the voice vote but did not debate publicly the issue before the board. He released a statement saying that "these are extremely difficult economic times that require tough choices."

"Now is not the time to increase the demands on our already overburdened community college system," Dalton added.

The rules, which would almost mirror guidelines for University of North Carolina campuses, would allowed illegal immigrants to enroll in any of the system's 58 campuses if they have graduated from a U.S. high school.

But they also would have to pay the out-of-state tuition rate of $7,700 per year with full course loads, or nearly five times the in-state rate, according to system data. They also couldn't qualify for financial aid or take the place of students who are legally in the U.S. on crowded campuses.

The policy "is still going to very restrictive for an awful lot of these students," said Tony Asion, executive director of the Hispanic advocacy group El Pueblo, who wants in-state tuition for undocumented immigrants. "But at this point it's better than nothing."

With some campus presidents seeing 20 to 30 percent enrollment increases this year as unemployed workers try to retrain for a new career, illegal immigrants would get lower priority for admission.

"My personal belief is that we'll end up averaging no more than one or two students per college," Fountain said.

The system had 111 illegal immigrants enrolled during the 2007-08 school year, according to an outside consultant's report presented in April to the board while it formulated a policy. In 2007, the system replaced a policy giving campuses the option to enroll undocumented immigrants with a requirement that they do so.

About 50 opponents to the change picketed outside the state's community college offices Thursday while a committee discussed the policy. There were no protesters Friday.

"For our state to be assisting people illegally here to be better trained so that they can possibly take jobs or will take jobs from North Carolinians just seems to be a wrong-headed type of policy," said Ron Woodard, director of NC LISTEN, a Cary-based group that lobbies for less immigration.

Gov. Beverly Perdue, another Democrat, was also opposed to the community college enrollment change, telling reporters this week it's hard to understand why the state should educate people "when they can't work legally in the state after they're educated."

Senate Minority Leader Phil Berger, R-Rockingham, criticized the decision and suggested Perdue could have lobbied more to block the change.

"This action is a slap in the face to legal North Carolina residents that desperately need access to the job training provided by our community colleges during the worst period of unemployment since the Great Depression," Berger said.

A governor has no direct authority over the board but appoints 10 of the 21 members. Perdue has appointed four of them since taking office in January.

The vast majority of states admit undocumented immigrants, Fountain said. Of 11 states reviewed in the consultant's report, five offered in-state tuition rate to undocumented immigrants, five required the out-of-state rate and South Carolina had a ban on admissions for illegal immigrants.

The new policy "keeps us in the mainstream of educational thought in the United States," Fountain said.

The policy still must go through a procedure required of most rules approved by state agencies. The Legislature could still have the opportunity to reject the rule when it reconvenes in May or override it with its own law.

What part of ILLEGAL do these traitors not understand? Every board member who voted in favor of this should be arrested for aiding ILLEGALs. This is a slap in the face to the AMERICAN citizens of NC and the whole country. All this is going to do is bring more ILLEGALs into our state. ILLEGALs already kill thousands of AMERICAN citizens every year, bring more crime and drugs, and cost the AMERICAN taxpayers BILLIONS of dollars every year. THIS IS A DISGRACE!!!!!!!!! It just shows that those elected to office do not represent those who elected them. It is a fact that over 80% of AMERICANS do not want any benefits for ILLEGALs, but want ENFORCEMENT! Yet as you can see by this decision, those elected by the AMERICAN citizens of NC do not care what you think. AMERICANS better wake up. I am so disappointed that our 'leaders' are more concerned about the ILLEGALS getting into OUR colleges and schools, than taking care of 'we the people'. Please tell me why we are not deporting these ILLEGALS? Are we trying to reward them for being here illegally? I am SO confused! We freely give them medical care and God knows what else! My husband and I have been unemployed for a long time, and WE, who are LEGAL, native born citizens, don't have this! Anyway, don't give away to those that are here ILLEGALLY, what should be for 'we the people', PLEASE!

Give the Americans who have lived and worked here all their lives the same breaks these illegals are getting. They don't have social security cards so how are they going to work to pay the tuition? The parents must be working for cash or with falsified documents since they came here illlegally to begin with.Taking jobs from us too! They don't pay taxes,just tax our resources. Americans should all be fed up to their eyeballs the way these elected officials keep putting it to us!!!

I cannot believe this! Our daughter (a legal resident of NC) had a terrible time getting her college classes this past semester because of overcrowding at UNCG as well as GCC due to budget cuts. Whoever made this decision is ill-informed of the current crisis situation and needs to be fired.

I am relieved. People come here looking for something better. Instead, they often are met with ignorance and inhumane people...and a severe lack of understanding about why a person would choose to leave their home and possibly die to escape. And, as for budget cuts, did you not read the part about out of state tuition for community college? That's a ton of money that might be able to go to the school. Also, these children did not choose to come here, but they have grown up here.

kalandra - I agree. If only we could figure a way to get money from everyone who is breaking the law. Life would be perfect. Maybe we could start by arresting / fining those who voted to aid illegal activity.
I hope it doesn't happen, but if someone breaks into your home; then decides to stay - remember to welcome them with open arms - afterall they might help pay your light bill ...

This is just another peice of the puzzle. Obama is going to making his push for AMNESTY for tens of MILLIONS of ILLEGALs. When Rep Joe Wilson called out "YOU LIE" in regards to Obama saying ILLEGALs would not be covered under the health plan, he was correct. There are no provisions in place to prevent ILLEGALs from getting health benefits. In fact, the democrats voted out a proposal by republicans (I am neither republican or democrat)to enforce verifying the LEGAL status of those seeking care. ILLEGALS are not supposed to be getting Medicaid or welfare benefits now, but they do to the tune of HUNDREDS of MILLIONS. So you can bet that yes they will be covered under the new plan. As I said before, AMERICANS better wake up! Obama claimed to be a Christian during his campaign when it was said he wasa muslim. Then when the truth came out about the "church" he went to led by the racist, radical Jeremiah Wright, he distanced himself from that. He has said whatever the AMERICAN people wanted to hear to get elected. Now he has elected a know member of LaRaza to the Supreme court in Sonyia Sotamyer. This was just part of his plan to legalize tens of MILLIONS of ILLEGALs against the will of the AMERICAN people. Wake up AMERICA! He is trying to push legislation through with record speed so that "WE THE PEOPLE" will not fully know what it contains and what it will cost. We are the sheep being led to slaughter.

H.R. 3200, Section 246 says: "Nothing in this title shall allow federal payments for affordability credits on behalf of individuals who are not lawfully present in the United States.", so I'm not sure who the "we" are of whom you speak, but you're wrong.

Now, there doesn't appear to be any portion that addresses how/when that should be verified, but if they do choose to include it, hopefully it will be referred to as "here's the stuff I need to say/produce/forge/etc. to get past this" section.

In short, laws are followed by the lawful, much as locks are made to keep out honest people.

Please note this has nothing to do with covering emergency treatment of anyone, regardless of status. And yes, there is legislation in place allowing the Federal Government to reimburse hospitals for care given to illegal aliens (Medicare Prescription Drug, Improvement and Modernization Act of 2003).

You know Joe Wilson voted for that...right?

I'm an American too and I applaud our elected leaders for this decision. We insist for these children to pledge of allegiance to our flag and now they can mean it. We cannot on one hand shove patriotism down their throats and then slap them in the face by denying them an education. When they say the pledge of allegiance in the schools now, they will know that they do have a chance of a becoming a contributing member of American society.

Funny how you seem to think you're the expert on what an American should or should not say. I am a U.S American and I am proud to say so. Proud for the freedom of speech and proud of our leaders who will not villanize these children. Just an FYI, children may not be forced to say the pledge of allegiance, they just get detention if they do not. If that's the case, let's give them a reason to love this country and want to pledge an allegiance to it.

You are simply WRONG. The Supreme Court in 1943 ruled school children cannot be forced to say the Pledge of Allegiance. Therefore they also cannot be held in detention if they do not say the Pledge. That also would be against the Supreme Courts ruling.

Hmm teachers and principals breaking the law by giving students detention for not saying the pledge of allegiance. Happens all the time. Regardless, I'm glad for once we are not villanizing the children. It gives hope to the future of this country because like or not, these children are part of that future.

I undersatnd what the term illegal means. What many people don't understand is that this is not that big of a deal. We're talking about 111 people who want to get an education. And those 111 will now have to pay double the rate they were paying last semester. Most are probably kids of illegal immigrants. Should we just deport them, although they grew up in the US, learned our language and now want to participate in what americans consider valuable - an education? Seriously, in the end, what is the impact going to be here? 111 illegal immigrants isn't even a drop in the bucket compared to the NC population. People are making this out to be an earth shattering decision and it's not. What happened to empathy? What about respect and building yourself up? Isn't that what they are trying to gain/do? They are trying to live the values we've stuffed down their throats. Also, whyus, my husband went back to school this semester. Because he was a freshman, he had pick of the last, crappiest classes. That's how it works. Get over it and tell your daughter to stop whining.
