Man steals cats from shelter to save their lives

Friday, July 10, 2009
(Updated 2:55 pm)

REIDSVILLE — The cats scheduled to be euthanized Tuesday morning at the Rockingham County Animal Shelter couldn’t buy any more time.

So, Edward McIrvin decided to buy it for them.

Reidsville police issued warrants against McIrvin for crimes he freely admits committing: breaking into the shelter and stealing 37 cats.

And René Jackson, the former shelter director, said she was fired this week after being accused of aiding McIrvin in the theft.

McIrvin said he made the decision about 10 p.m. Monday in a moment of desperation, fearing all the cats would be killed Tuesday, one of the shelter’s two euthanasia days.

“I just simply could not live with that,” McIrvin said in a phone interview late Thursday.

The cats were reported stolen Tuesday morning by staff at Reidsville Veterinary Hospital, which contracts with the county for shelter space.

McIrvin faces charges of felony breaking and entering and felony larceny, said police Lt. Wendell Neville. He plans to turn himself in.

As for the cats, they’ve been returned in good condition.

“Mr. McIrvin was trying to provide care for these animals and have them adopted,” Neville said.

“He was providing well for them.”

McIrvin, 43, of Greensboro said he is an indoor environmentalist who works for his father’s company, Skylon Innovations. He has volunteered at the Rockingham County Animal Shelter since spring, doing odd jobs such as replacing water dishes and building wooden shelves inside the cages.

“There were a number of small projects that I was doing to improve the environment,” he said. “I was focusing my energy, my attention on creating a much more harmonious space at the shelter.”

But McIrvin’s role at the shelter changed late Monday afternoon. He remembers it being hectic, with at least 70 animals scheduled to be euthanized the next day. Jackson was making calls to try to quickly move some of the animals out the door.

Jackson said Thursday she saved about 25 through fostering and rescue groups. But most were dogs.

“No one came for the cats,” said McIrvin, who has a particular affection for felines.

McIrvin called his father and stepmother, who are active in PETA, and others he knew to find the cats homes. “I was not successful,” he said. “That is when I decided I must rescue the cats.”

He spent $700 in four hours at Walmart buying crates, litter boxes and towels. About 5 a.m. Tuesday, McIrvin said, he drove to the shelter in a service truck and entered through an unlocked back door. He lifted each cat from its cage.

He drove the cats to an old office above a house in Greensboro that his family owns. It was clean and vacant, an ideal spot for them. “It was a place where they could find their own space,” McIrvin said.

He said he left behind those that were feral and ill. “That was a painful, painful moment of decision.”

McIrvin planned to get the cats veterinary care and foster them. But their freedom was short-lived.

About 9:30 a.m. Tuesday, McIrvin received a call from a Reidsville Veterinary Hospital staff person. He was asked if he knew where the cats were and was told that the police were involved. After investigators interviewed him, McIrvin said, he was allowed to return the cats with a police escort.

The Rockingham County Animal Shelter has been plagued with problems for years. The small building on Reidsville Veterinary Hospital’s West Harrison Street property has struggled with crowding and euthanasia rates that reached 98 percent.

The county is in the midst of a fundraising campaign to build a new $1.8 million shelter in Wentworth.

Even with criminal charges hanging over his head, McIrvin still hasn’t given up on those cats.

He delivered $5,800 to Steven Swanner, a veterinarian with the Reidsville Veterinary Hospital, on Thursday night. The money will be used to pay for adoption and spay and neuter fees for the 37 cats — four of whom are pregnant — for those who adopt them.

McIrvin said he has one week to get them adopted, and then the clock starts ticking once again.

“The No. 1 goal that I had hoped to achieve was that they would be spared,” he said. “I have basically spent a great deal of money to buy me a little bit of room to breathe.”

Anyone interested in adopting the cats should call the Reidsville Veterinary Hospital at 349-3194.

Countryboy, I'm sure you missed the point of this blogging - PETS - NOT people. I'm sure there's an appropriate place to post these views, but this IS NOT IT. Now back to the subject, God Bless you for caring enough about some of God's creatures to try to do something to help them.

The point, or theme, of the article from a literary perception is the great extremes people will go to for a cause...in this case, animals were the object, but passion was the theme. With that in mind, it is entirely appropriate to compare the passion our society has for animals with the animosity some members of society have for the unborn. I appreciate your view, but encourage you to dig deeper into the article.

There are many-many ghost in the RVH closet that need to be looked at. Complaints filed with the State that go ignored, why a shelter in this shape is allowed to operate at all. Where is the money going? RVH charges $45.00 for a microchip on a shelter dog, the chip cost them $4.95 and most Vet's will insert them for free on a rescue or shelter dog. RVH charges $35.00 for a Rabies shot, a rabies vaccine at cost is $5.00. Please tell me they are not in it for the money, those two procedures is a profit of $70.00 on any animal. Don't you think they are in it for the money. And yes there needs to be an audit. You can not combine two business accounts into one, how do you explain that to the IRS? The accounting for the shelter and the accounting for the Vet Hospital must stay in separate. Don't think for one minute RVH does not have blood on their hands. I don't know Dr. K sleeps at night in his big old house on the hill.

There are way too many things wrong with the Rockingham County Shelter. Too many conflicts of interest and it's time that an organization, unaffiliated with a particular Veterinary Clinic step in and run it the right way already. This man was following his heart and I commend him. The property of these cats really had no value so what is really the problem with Mr. McIrvin taking them rather than killing them? Are you seriously that kill happy?

A local animal group offered to the county a few years back to go & have the county build the shelter & let the group run it, BUT the county said no. They feel that they should run it, but since having to get things together for the new shelter I believe that the county has been overwhelmed w/ what it is going to take to run this shelter. The expense alone is mind boggling. I hope they look into asking a coalition or a group to run this in the future.

Good for him! These cats thank him! I always hate hearing about Rockingham County shelter, because its KNOWN to be a killer of animals, especially cats! And they say good samartians don't exist anymore. He's going straight to heaven for that alone! Well done

CopOnTheBeat

While I applaud the man's efforts to save the animals, of course, I do not advocate what he did in breaking the law and committing a break-in and multiple counts of theft. I am the proud owner of a shelter animal myself, they make excellect pets. But the sad reality is, many people would rather go to some pet store and plunk down hundreds or a thousand dollars or more for a dog...while the ones at the animal shelter wait for the clock to stop ticking. Don't believe it? Just take a ride to the pound and see for yourself. And feel free to see the truckloads of dead dog and cats that end up in landfills every week all because they went unclaimed or people just stopped wanting them and time ran out. Its not an animal problem...its a human problem. I think Mr. McIrvin just snapped from seeing this over and over again. He broke the law which was wrong, but really, I pity the man because I empathize with him somewhat. I've seen the horror firsthand. I didn't sleep the first time I visited an animal shelter. It was one of the most pitiful things I've ever seen.

I don't buy the argument that the animals were going to die anyway...so what was the harm of Mr. McIrvin taking them. There was lots of harm...including the fact that he couldn't care for them long-term, he was 'hoping' to adopt them out to others, they would eventually become a problem because of the smell and other problems, veterinary care, breeding (all that many cats together...something is bound to happen) -- and the possibility of being stuck with cats that no one wants, and they eventually end up being picked up by animal control again. Just watch animal cops programs on the Animal Planet channel to see all the cases of people hoarding animals...which is abuse in itself.

Point the fingers of blame at Mr. McIrvin...point them at the owner of the veterinary hospital...point them here, point them there. But remember, ultimately, the finger of blame should be pointed at the worthless and ignorant people who possessed the animals that ended up at the shelter. If they had been responsible and spayed and neutered to begin with...and if they had kept them from roaming...they wouldn't be there for Mr. McIrvin to snatch...and for a judge to decide what to do with him.

All around, this is a sad case. While he broke the law, honestly, I wish Mr. McIrvin well.

He was going to get the help of Rescue Groups to adopt the cats out. Also, I am sure that he would have had help from the groups with the medical...but NOT at Reidsville Vet.

I think the people at Duke Animal Law need to look at the situation that is happening at RVH....

I also saw the post about the man just throwing the cats into a cage where one had a rope around it's neck and possibly dead, this person should be prosecuted for animal cruelty.

What a sad state this world has come to when we think no more of animals than as throw away trash to be killed and go to the landfill.

When are the people of Rockingham County going to stop letting their tax dollars pay for the mess behind Reidsville Vet Hospital? They will not let legitimate rescue groups come in and rescue these animals without charging rediculous prices, even if they do nothing to the animal. If they cant get that money, they would rather put them down and toss them in the land fill which, by the way, they charge the county to do to. All the while the county is paying them THOUSANDS OF YOUR DOLLARS A YEAR for this mess. They dont want to deal with rescue groups, they dont want to deal with the shelter at all, they just want the MONEY!!! I would not take a snake to that place! It is a crime what these people are doing with our money. Mr McIrving committed no crime; since when is saving a life a crime??? He should not have had to resort to "stealing" the cats. If he was willing to take them, why didnt they just GIVE THEM TO HIM????

I thought for larceny to be a felony, it had to be over a certain dollar amount.

How much are cats that are going to be killed worth, exactly?

Then again, a bag of cats in the right neighborhood can fetch a pretty good price.

countryboy

July 10, 2009 - 11:36 am EDT

A dollar amount is necessary for a simple larceny...Breaking or entering elevates it.

§ 14‑54. Breaking or entering buildings generally.

(a) Any person who breaks or enters any building with intent to commit any felony or larceny therein shall be punished as a Class H felon.

July 10, 2009 - 12:22 pm EDT

Thanks, country boy. Good to know. Do they still consider it breaking and entering if the door is left unlocked?

countryboy

July 10, 2009 - 2:22 pm EDT

Yes...the threshold is the point of entry, be it a window or a door, locked or unlocked. Therein lies the distiction between breaking or entering (often misquoted as breaking AND entering). Same statute, different wording. Open areas such as a yard or parking lot would be trespassing...no fence or security but posted is 2nd Degree...fenced would be 1st Degree.

When is the new facility suppose to be built? The shelter now is in such bad shape. My mom & stepson went the other week to adopt a dog. What was seen by my step-son has really upset him. He said a man came in there with cats & kittens and threw them in the cages! He said they were brought in with something around their necks and he thought one cat was dead because it just about choked to death. I think handling animals should be done in a humane way and especially in front of KIDS!. The place stunk and my stepson had to leave because he could not watch what that man was doing to those animals. I think if you are going to work in a place like that, you need to treat the animals right. There isn't enough room in that place to turn around and the poor animals don't have a chance. It's so sad. All of my animals have been adopted and all are spayed or neutered.

Who was that man, Animal Control?

Lisa03

July 10, 2009 - 12:20 pm EDT

I am not sure. My step-son just said a man came in with the animals and threw them in there. So I don't know if it was the animal control person or a person that worked there. Either way, what my step son saw was very damaging to him being a child and an animal lover that he is

Falcon79

I am sure it was Animal Control. Those guys do have a hard job, BUT they don't try to be nice somedays either. They will everything in on a catchpole. & Yes some get enjoyment out of having that control over some of the pooor defenseless animals. Some of them you do need to to use the catchpole on, but others you don't. I am sorry for your child to have seen such a thing.

4 Quick things:
Bless his heart is right!

Lewis Veterinary Clinic 336.627.9600
Rockingham County's newest vet clinic, with VERY affordable prices, including Spay & Neuter. You can tell Dr. Combs and her staff are truly committed to the welfare of ALL animals.

Reidsville Veterinary Hospital operates the shelter, NOT Belmont Animal Hospital.

Renee Jackson is the best animal advocate/manager I believe the shelter has ever had. She is the second one to be fired in 7 months, presumably for caring about and trying too hard to place animals.

I am also an animal lover. This story touched me. I admire and respect this man for deciding the benefits of saving these cats were worth the risk of arrest and for spending his own money to get them spayed/neutered. A lot of people dismiss the lives of animals as less important and it is a tragedy to kill them just because they exist and do not have a home. Imagine the outrage if our society did that to the homeless people. Animals are great company and unconditional love. I can't imagine my life without my cat. Kudos to the man who has one of the biggest hearts I have ever heard of.

I forgot one thing on my previous comment. Big kudos to Rene Jackson if she did have a role in helping Mr McErvin save these cats. She should get her job back. She has heart and it takes heart to run a shelter.

Civil disobedience at it's best! In this case he did the moral thing, not the legal thing. I can't say a bad word about him and his deed.

countryboy

July 10, 2009 - 2:25 pm EDT

This was not an act of Civil Disobedience. It was a felony. The sad part is the money that will be used to investigate and prosecute the case could have been used to improve shelter conditions and place the animals.
