UNC's health care reform plan

The UNC system is moving ahead with its own version of health care reform.

And, apparently, its own public option.

Effective in 2010.

How, exactly, did the UNC system obtain a power that is not held by the state (which, under current law, doesn't require health insurance)? What else could UNC require of its students?

Too bad for Obama he doesn't have this kind of dictatorial power floating free from representative democracy.
